The real estate licence of Lake Macquarie’s Anthony Di Nardo has been suspended by NSW Fair Trading for 60 days, effective immediately.
It comes after a formal Show Cause notice was served on the ex-Belle Property principal, following several allegations of workplace misconduct, which he denies.
The action’s a blow to Mr Di Nardo, who’s preparing to relaunch under a new brand Prestige Real Estate Agent.
It’s understood the current suspension arose as NSW Fair Trading believes there are reasonable grounds for disciplinary action against him.
That’s on the basis that he may not be a fit and proper person to be involved in the direction, management or conduct of the business of a licensee.
Mr Di Nardo is alleged to have engaged in contraventions of the law, including behaviour relating to indecent assault, sexual touching, sexual assault, and stalking or intimidation with intent to cause fear of physical or mental harm.
These matters are being investigated by NSW Police and currently before the courts.
“Mr Di Nardo is facing serious allegations,” NSW Fair Trading Commissioner Natasha Mann said.
“NSW Fair Trading has regulatory powers to determine if a real estate agent is a fit and proper person to hold a licence.
“As our enquiries are ongoing, further comment is not available at this time.”
A response to the Show Cause notice is required by 23 March.
But, while suspended, Mr Di Nardo is not permitted to conduct business as a real estate agent.
NSW Fair Trading’s regulatory action remains separate from criminal charges laid by NSW Police.
Disciplinary measures, including suspension pending possible punitive action, are published on the ‘Name and Shame’ List.
It’s a public search tool that allows people engaging with the property market to research action taken against licensed real estate and strata managing agents.
